Terms and Conditions

These Terms and Conditions govern your use of wakeel, an online insurance brokerage platform owned and operated by ACE Gallagher Insurance Brokerage Company (“wakeel”). These Terms, together with our Privacy Policy and any other terms agreed upon between you and the Agent from time to time, constitute the entire agreement between you and the Agent regarding the use of the platform and Services.

By continuing to access or use the platform, you acknowledge that you have read, understood, and agreed to these Terms as amended from time to time. If you do not agree with these Terms, you must immediately stop using the platform.

Terms of Use

  • You must be at least 18 years old (Gregorian calendar) and legally competent to create an account and use the Services.
  • If you are using the platform on behalf of a third party, you confirm that you are legally authorized to represent that party and to enter into any obligations on its behalf.
  • Insurance brokers or sales agents are strictly prohibited from using this platform, in accordance with the regulations of the Insurance Authority (IA) and our policies. Such use is considered unlawful.
  • Platform Services are limited to personal and legitimate commercial use. Users are fully responsible for all transactions and activities conducted through the platform.

By using the platform, you agree to:

  • Provide accurate and complete information, avoid misleading data, and update your information when necessary.
  • Refrain from actions that violate the rights of wakeel or any third party.
  • Not copy, reproduce, distribute, or manipulate any content on the site, including but not limited to texts, designs, images, videos, files, databases, or catalogs. You will not use such materials in a manner that directly or indirectly competes with the platform.

Accounts

  • To access the full features of the platform, you are required to create a personal account secured by a password.
  • You must provide accurate, complete, and up-to-date information when creating your account and update it promptly if any changes occur.
  • You are responsible for maintaining the security of your account and are liable for all activities conducted through your account.
  • Any suspected fraudulent or unauthorized activity must be reported immediately.
  • We reserve the right to suspend, terminate, or refuse service, or block access to the platform at our sole discretion.

User Data

  • By using the platform, you consent to the collection, transfer, and sharing of your personal and insurance-related information with insurance companies and other relevant entities.
  • You represent and warrant that all data provided is accurate and complete. Failure to provide accurate information or disclose all material facts may render your insurance product void and could prevent claim payments. We are not liable if the product you selected is invalid due to your failure to provide accurate information or disclose material facts.

Services and Products

  • The platform displays insurance Products from Insurance Authority-licensed insurers for comparison purposes, without favoring any product or providing direct or indirect recommendations. The final choice of coverage and pricing rests solely with you.
  • You may purchase insurance policies and pay premiums directly through the platform, with a digital version of the policy available in your account.
  • Insurance policies are issued subject to the terms and conditions of the issuing insurer. Coverage begins only upon approval and issuance by the insurer.

Using the Platform Services

  1. Enter the required information to receive insurance quotes.
  2. The platform presents available offers with additional benefits and provides a comparison table to help you evaluate price and features.
  3. Select your preferred offer and proceed with the purchase and payment method.
  4. Enter payment information.
  5. The insurer approves and issues the policy; a digital copy is sent to your account.
  6. The issued policy is subject to the issuing insurer’s terms and conditions.

Claims and Inquiries

  • All claims and inquiries must be directed to the issuing insurance company.
  • wakeel does not receive, process, or pay claims, but will provide support to assist users with claim procedures.

Payment

  • All prices are in Saudi Riyals (SAR) and include applicable taxes. You are responsible for ensuring your bank or payment provider does not charge additional fees. wakeel is not responsible for any third-party fees.

Liability and Indemnity

  1. You acknowledge that wakeel is an electronic insurance broker and display platform, and is not responsible for paying claims or compensations arising from third-party (insurer) default.
  2. We ensure that product offers and pricing information are accurately reflected through our comparison technology. We are also responsible for the factual data provided and for protecting your information in accordance with Insurance Authority regulations.
  3. While we strive to provide high-quality, virus-free Services, we do not guarantee uninterrupted or error-free operation, or compatibility with any third-party software.
  4. You waive any claims against wakeel, its employees, shareholders, affiliates, agents, or licensors arising from your access or inability to access the platform.
  5. If liability is established by a competent court, the maximum compensation is limited to the amount paid for the product purchased through the platform, provided liability is proven.

External Links

  • wakeel may provide links to external websites. Clicking such links means you leave wakeel’s platform. We are not responsible for content, cookies, data collection, or privacy practices on external sites. You are solely responsible for reviewing the external site’s terms and policies.

Intellectual Property

  • All content on the platform, including text, designs, images, videos, interactive features, logos, and layouts, is the exclusive property of wakeel.
  • All trademarks and trade names, including “wakeel,” are owned by wakeel or licensed parties and may not be used without prior written consent.
  • You agree not to copy, reproduce, reverse engineer, or manipulate any content or intellectual property without prior written approval.

Severability

If any provision is deemed unlawful or unenforceable by a Saudi court, the remaining provisions remain in effect.

Amendments

We may amend these Terms or the Privacy Policy at any time without notice; changes apply once published.

Notices

Governing Law and Jurisdiction

These Terms are governed by the laws of Saudi Arabia. You agree that any disputes related to the platform are subject to the exclusive jurisdiction of the Saudi courts, regardless of your location.
